YachtVerify document check, free valuation and listing requests. For the broker subscription, see the broker subscription terms.
1. Purpose
These terms and conditions govern the document check service offered by YachtVerify on yachtverify.com. YachtVerify is a brand operated by SALLES, a SASU (French single-shareholder simplified joint-stock company) with share capital of €1,000, registered with the Nice Trade and Companies Register under number 989 432 463, whose registered office is at 65 boulevard de la Corne d'Or, 06230 Villefranche-sur-Mer, France (hereinafter "YachtVerify"). Contact: contact@yachtverify.com. The service consists of examining the documents relating to a boat, supplied by the requester, against an 11-point grid, and, if the five main mentions are verified, publishing the result on a record attached to the boat's hull number (HIN) and issuing a badge. Otherwise nothing is published and the requester receives a private report. YachtVerify checks documents and facts. YachtVerify does not inspect the boat, gives no opinion on its condition, seaworthiness or technical compliance, and does not replace a pre-purchase survey carried out by a marine surveyor.
2. Definitions
Requester: the person who orders the check (private owner or broker authorised by the owner). Boat: the boat identified by its hull number (HIN or CIN). Grid: the list of the 11 points checked (hull number, engines, CE compliance, flag, ownership, seller, mortgage, leasing, VAT, engine hours, maintenance). Mention: a result obtained when all the points that make it up are verified (Identity confirmed, Ownership confirmed, Mortgage status, Financing, VAT status, Documented history). Level of evidence: a point is verified on document, or on the Requester's signed declaration (tick box, name, date) where a declaration is enough. VAT status: the Boat's situation with regard to VAT at the date of the check, either "VAT paid, evidenced" (evidence required: original invoice showing VAT, VAT-paid certificate or customs document) or "VAT not paid, sale without VAT" (the Requester's signed declaration and reason, with the supporting document if available). An unknown status does not allow the Badge to be issued. Record: the public page of the Boat on yachtverify.com, published only when the Badge is issued. Private report: the report sent only to the Requester when the Badge is not issued. Badge: the image and QR code issued when the first five mentions are verified.
3. Order
Orders are placed online: information on the Boat, identity of the Requester, upload of the documents, acceptance of these terms and conditions, payment. The Requester warrants that the information supplied is accurate, that the documents are authentic and that they have the right to transmit them. A broker must attach the owner's authorisation; YachtVerify may refuse or suspend a check in the absence of a valid authorisation.
4. Price and payment
The price depends on the overall length of the Boat: under 12 m: €190; from 12 to 18 m: €390; from 18 to 24 m: €690; over 24 m: on quotation. Any new check of a Boat already checked by YachtVerify, whether or not it has a Record, is charged at half price. Prices are stated inclusive of all taxes. Payment is made in a single instalment, by card, via Stripe. No subscription is taken out. The price pays for the check, not for its result. No refund is due once the check has started. Consumers keep their statutory right of withdrawal under the conditions of article 10; businesses do not have it.
5. How the check is carried out
The check begins within an indicative period of 48 working hours after payment. Each point receives one of the following statuses: verified on document, verified on the seller's declaration, not verifiable, refused (and, for the CE compliance of a boat built before 1998, not applicable). The signed declaration is enough, except where a document is required: declared mortgage (lender's consent or redemption statement), title in the name of a finance company (the company's certificate), VAT paid (evidence). The Requester has 60 days from payment to provide or correct a document, at no extra cost. Missing documents are requested by email; a reminder is sent 15 days before the deadline. YachtVerify may grant an extension. At the deadline, the check is closed on the basis of the information available.
6. Result, Record and Badge
The Badge is issued only if the five mentions Identity confirmed, Ownership confirmed, Mortgage status, Financing and VAT status are verified. Only in that case is the Record published at closing, with: make, model, year, flag, verified mentions with their date and level of evidence, options not verified, date of the check. The Record never shows the name of the owner or the Requester, the documents or the price of the Boat. By placing an order, the Requester accepts this publication. If the Badge is not issued, nothing is published: the Requester receives a private report showing the points verified, their level of evidence, the points missing and the documents to provide to obtain them. The Mortgage status and Financing mentions are verified when the situation is established and documented, including where a mortgage or a lease in progress is to be settled on sale; the charge is then shown on the Record, without the institution's name or any amount. They are not verified if a charge exists without being documented. The mortgage status may rest on the seller's signed commitment statement; the Record says so. A sale without VAT is shown on the Record in the same way. YachtVerify states the Boat's VAT status as at the date of the check; any VAT payable by the buyer depends on their own situation. The information is valid for 12 months from the date of the check. After that date, the Record remains online and shows the date of the last check; the Badge is no longer valid. The last published check is authoritative. YachtVerify may correct or withdraw a mention or a Badge if it appears that a document was inaccurate or falsified, or in the event of a clerical error.
7. Scope and limits of YachtVerify's commitment
YachtVerify's commitment is limited to the document check described above. It is an obligation of means (best endeavours): to examine carefully the documents supplied and the seller's signed declarations, and their consistency. In particular, YachtVerify does not guarantee: • the condition, value, safety or technical compliance of the Boat; • the absence of latent defects; • the authenticity of a document falsified in a way that cannot be detected by a document examination; • facts arising after the date of the check (new mortgage registration, new leasing, transfer of ownership…); • the completeness or accuracy of registers and information held by third parties. A Record or a Badge is neither a guarantee, nor a certification, nor an opinion on whether to buy or sell the Boat.
8. Liability
Subject to the mandatory provisions applicable to consumers, YachtVerify's liability, for all causes combined, is limited to the amount paid for the check concerned. YachtVerify is not liable for purchase, sale or financing decisions taken by the Requester or by third parties on the basis of a Record or a Badge, nor for indirect damage.
9. Use of the Badge
The Badge may be used only for the Boat concerned and during its period of validity. It must not be modified. The QR code links to the Record, which at all times reflects the actual status of the check.
10. Right of withdrawal (consumers)
Consumers have a period of 14 days from the order to withdraw. At payment, they expressly request that the check begin immediately and acknowledge that they lose their right of withdrawal once the check has been fully performed. If they withdraw after the check has begun, they remain liable for an amount proportionate to the work carried out; if the check has been fully performed before the end of the period, the right of withdrawal can no longer be exercised. Businesses do not have a right of withdrawal. To exercise this right, consumers send an unequivocal statement to contact@yachtverify.com, or use the model form below. Model withdrawal form (Complete and return this form only if you wish to withdraw from the contract.) To SALLES (YachtVerify), 65 boulevard de la Corne d'Or, 06230 Villefranche-sur-Mer, France — contact@yachtverify.com: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service: — Document check of the boat (hull number): — Ordered on: — Name of consumer(s): — Address of consumer(s): — Signature of consumer(s) (only if this form is notified on paper): — Date: (*) Delete as appropriate.
11. Personal data
The data and documents submitted are processed in order to carry out the check, in accordance with the privacy policy available at yachtverify.com/privacy. The documents are never published.
12. Free-vurdering
The website offers a free valuation of a boat. This valuation is an indicative selling price, calculated automatically from listings of comparable boats published online and, where applicable, declared sales, together with the information entered by the user. It is neither a guaranteed price nor an official valuation, and it does not replace a survey. YachtVerify does not guarantee that the boat will sell at this price and is not liable for decisions made on the basis of this valuation. The valuation does not bind the user or YachtVerify. The user guarantees the accuracy of the information entered. When the information does not allow a reliable calculation, no figure is shown.
13. Listing request and brokers
After the valuation, the owner may submit a listing request free of charge to receive proposals from brokers covering the area of the home port. The listing request is shown to registered and approved brokers covering that area; the owner's contact details are only passed on to the brokers who open the listing request, three at most. The conditions of this transmission, the retention period (12 months) and the right to withdraw are set out in the privacy policy (section 9). YachtVerify puts the parties in touch and is not a party to the sales mandate or to the sale. The owner remains free to accept no proposal. Brokers are bound by the broker subscription terms (yachtverify.com/terms-brokers).
14. Governing law and disputes
These terms and conditions are governed by French law. In the event of a dispute, consumers may refer the matter free of charge to a consumer mediator, whose contact details are provided on simple request to contact@yachtverify.com. Failing an amicable settlement, the competent courts are those designated by law. Contact: contact@yachtverify.com
