Broker subscription terms
YachtVerify broker subscription: free sign-up, no card. The subscription, €199 excl. VAT per month with no commitment, gives access to the listing requests in your areas.
1. Purpose and parties
These subscription terms (the "Terms") govern the subscription of boat sales professionals ("Brokers") to the YachtVerify service, available on yachtverify.com. The service is published by SALLES, a French SASU with a share capital of €1,000, registered with the Nice Trade and Companies Register under number 989 432 463, whose registered office is at 65 boulevard de la Corne d'Or, 06230 Villefranche-sur-Mer, France, represented by its president, Loan Salles ("YachtVerify"). Contact: contact@yachtverify.com. The service gives access to the requests of owners who wish to sell their boat ("Listing Requests"), submitted after a free valuation on the website, in the geographical areas chosen by the Broker. YachtVerify puts the owner in touch with Brokers: YachtVerify is not a party to the sales mandate (central agency) agreed between the owner and a Broker, nor to the sale of the boat, and receives no commission on the sale. The website's general terms (yachtverify.com/terms) apply for everything else, including the document check; in case of conflict, these Terms prevail for the subscription.
2. Professionals only
The subscription is reserved for persons acting in the course of their professional activity as intermediaries in the sale of boats. By registering, the Broker declares that it acts in this capacity. Consumer law provisions on the right of withdrawal do not apply.
3. Registration and account approval
Registration is free and requires no means of payment. The Broker registers online and provides accurate, up-to-date information: identity, agency, contact details, areas. From registration, the Broker sees, for each of its areas, the number of Listing Requests waiting, their total estimated value and their split by size, with no detail of any Listing Request, and receives alerts limited to this information. YachtVerify checks the declared professional activity and approves the account before any subscription is taken out; YachtVerify may request any supporting document and refuse a registration without giving reasons. Login details are personal. The Broker keeps them confidential and is responsible for any use of its account.
4. Price and payment
The subscription is required to see and open Listing Requests. A Broker whose account is approved takes it out from its area ("Subscribe to access listing requests"): it is directed to Stripe's secure payment page, and access to Listing Requests opens as soon as Stripe confirms the subscription. If the payment is abandoned or declined, no subscription is taken out and nothing is charged. The subscription costs €199 excl. VAT per month, plus VAT at the applicable rate, payable from subscription. No free trial period is granted. The subscription is paid by card, through the payment provider Stripe, every month on the anniversary date of the subscription. An invoice is issued for each payment and remains available in the subscription management area. If a payment fails, the Broker is informed by email; access to Listing Requests is suspended until payment is made.
5. Term and cancellation by the Broker
The subscription has no minimum term. The Broker may cancel it at any time from its area (Settings, "Manage my subscription"). Cancellation takes effect at the end of the current monthly period: access remains open until that date and no further payment is taken. The current period is not refunded pro rata. When the subscription ends, access to Listing Requests ends, including Listing Requests already opened and the owners' contact details. The account remains open: the Broker only sees the counters for its areas again and may take out a new subscription under the conditions of section 4.
6. Listing Requests and how they are opened
Before it is opened, a Listing Request shows the type of boat, its rounded length, its age bracket, its condition, its VAT status, its flag, the estimated selling price (indicative), the area and the desired selling timeframe. All subscribed Brokers whose account is approved and who cover the area see this information. The make, model, year, engines, home port, photos, remarks and the owner's contact details are only shown to the Broker who opens the Listing Request. A Broker without a current subscription has no access to any detail of a Listing Request. Opening a Listing Request displays the full Listing Request together with the owner's name, phone number and email. Each Listing Request can be opened by three Brokers at most, in the order in which they open it. To prevent any mass collection of contact details, each Broker may open up to 20 Listing Requests per calendar month. The owner is informed of each opening (Broker's name, agency, city). The owner remains free to accept no proposal and may withdraw the Listing Request at any time; the contact details are then no longer displayed. YachtVerify does not guarantee any number of Listing Requests, the accuracy of the information declared by owners, or the signing of a mandate or the completion of a sale.
7. Broker's undertakings
By opening a Listing Request, the Broker undertakes to: • contact the owner within 48 hours of opening it, by phone, message or email; • use the contact details received only to offer its services for the sale of that boat; • not pass on, assign or sell them, nor use them for any prospecting unrelated to that boat; • stop all contact if the owner so requests or withdraws the Listing Request; • honestly record the state of the relationship in its area (contacted, meeting, mandate signed, no follow-up). Non-circumvention: the Broker shall not seek out, identify or contact, directly or through a third party, the owner of a boat it learned of through a Listing Request shown on the service without having opened that Listing Request on the service, including where the Listing Request has already been opened by three Brokers or where its monthly opening limit has been reached. This prohibition does not apply where the Broker shows that it was already in contact with that owner about that boat before the Listing Request was shown. The owner may report to YachtVerify any contact from a Broker who has not opened its Listing Request. The Broker carries out its activity under its sole responsibility, in compliance with the regulations applicable to it.
8. Document check included
The subscription includes the document check, by YachtVerify, of boats whose Listing Request the Broker has opened, at the Broker's request and with the documents uploaded by the owner. This check covers documents and facts, never the condition of the boat, and does not replace a pre-purchase survey by a marine surveyor. It follows the checklist and rules of the website's general terms (process, result, record and badge).
9. Suspension and termination by YachtVerify
If the Broker fails to meet its obligations, in particular repeated failure to make contact within 48 hours, complaints from owners, use of contact details contrary to section 7, circumvention of the service within the meaning of section 7, abusive opening of Listing Requests, inaccurate registration information or non-payment, YachtVerify may suspend access to Listing Requests and alerts. Except in an emergency, YachtVerify first invites the Broker by email to submit its observations within eight days. If the breach continues or is serious, YachtVerify may terminate the subscription by email. The current period is not refunded in the event of termination for breach.
10. Liability
YachtVerify has an obligation of means in providing the service. The estimated selling price shown in a Listing Request is an indicative estimate: it is neither a guaranteed price nor an official valuation. YachtVerify is not liable for the information declared by owners, for the outcome of exchanges between the owner and the Broker, or for the conclusion or performance of a mandate or a sale. In all cases, YachtVerify's liability under the subscription is limited to the amounts paid by the Broker over the previous twelve months.
11. Personal data
Broker data: YachtVerify processes the Broker's identity, agency, contact details, areas, alert settings, subscription and history of opened Listing Requests to manage its account, subscription, invoicing and alerts (legal basis: performance of the contract), and to prevent abuse (legitimate interest). Recipients: Stripe (payment and invoicing) and the technical providers listed in the privacy policy. Retention: for the duration of the subscription, then three years to manage the relationship; invoices are kept for ten years. The rights of access, rectification, erasure, objection and restriction are exercised at contact@yachtverify.com. Owners' contact details: for the contact details received when opening a Listing Request, the Broker acts as a separate data controller. It complies with the General Data Protection Regulation: informing the owner at the first contact, use limited to the purpose in section 7, proportionate retention, handling the owner's requests, data security.
12. Changes to the Terms
YachtVerify may change these Terms. The Broker is informed by email at least 30 days before they take effect; if it does not accept them, it may cancel its subscription before that date, under the conditions of section 5.
13. Governing law and disputes
These Terms are governed by French law. The parties first seek an amicable solution. Failing that, any dispute relating to their formation, interpretation or performance falls under the exclusive jurisdiction of the courts of Nice, France. Contact: contact@yachtverify.com
